8. Acceptable use & intellectual property

Do not misuse the site or services. All IDS materials, content, and marks are owned by IDS or its licensors and may not be copied or reused without permission.

9. Disclaimers & limitation of liability

The site, content, and services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. IDS does not warrant that the site will be uninterrupted, error-free, or secure. To the fullest extent permitted by Idaho law, IDS and its owners, members, managers, officers, instructors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the site or services; and the total liability of IDS for any claim arising out of or relating to the site or services (other than claims arising from participation in live training, which are governed by the signed Waiver and Release) will not exceed the amount you paid to IDS for the product or service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful or intentional misconduct, or personal injury to the extent such limitation is prohibited by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Governing law & disputes

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-laws principles. Before initiating any proceeding, the parties will attempt in good faith to resolve the dispute informally by written notice for at least thirty (30) days. Any dispute, claim, or controversy arising out of or relating to these Terms or the site or services that is not resolved informally will be resolved exclusively by final and binding arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures, before a single arbitrator, seated in Ada County, Idaho, with judgment on the award entered by any court of competent jurisdiction; the Federal Arbitration Act governs this Section. Where you are a consumer, arbitration fees will be allocated in accordance with the applicable JAMS consumer minimum standards. The parties waive any right to a trial by jury or judge, and — to the fullest extent permitted by law — agree that disputes will be arbitrated only on an individual basis and waive any right to bring or participate in a class, collective, or representative proceeding. Either party may instead bring an individual claim in a small-claims court located in Ada County, Idaho, so long as it remains there and proceeds only on an individual basis. This Section is intended to be consistent with the dispute-resolution provisions of the signed Waiver and Release; where a claim arises from participation in live training, the Waiver and Release controls.

STP is governed by its own STP Terms of Service and privacy terms provided by Integrated Defensive Technologies, LLC, which are presented at the point of sale and incorporated here by reference. Your STP agreement is with that affiliate, and IDS’s liability for STP is limited accordingly. STP is not currently available for purchase and these Terms will control the IDS website until STP is offered.
